1. Acceptance of Terms
By creating an account or using Oursly.io, you agree to these Terms of Service. If you don't agree, don't use the service.
2. Eligibility
- You must be at least 13 years old
- You must provide accurate account information
- You must not be prohibited from using Oursly.io under applicable law
3. Account Responsibilities
3.1 Your Account
- You are responsible for all activity under your account
- Keep your password secure (we can't recover it—zero-knowledge architecture)
- One person per account (no shared accounts)
- Notify us immediately if your account is compromised
3.2 Account Recovery
IMPORTANT: Due to zero-knowledge encryption, if you lose your password AND recovery key, your data is permanently unrecoverable—even by us. We cannot reset your password or decrypt your files.
4. Acceptable Use
You agree NOT to:
- Violate any laws (including DMCA, GDPR, CCPA)
- Harass, threaten, or harm others
- Distribute malware or viruses
- Spam or send unsolicited messages
- Attempt to hack or disrupt the service
- Use Oursly.io for illegal file sharing (piracy, CSAM, etc.)
- Create multiple accounts to abuse free tier
- Reverse-engineer or scrape the platform

5. Service Features
5.1 Chat (Matrix Protocol)
- End-to-end encrypted by default
- You control message retention settings
- We cannot read or moderate encrypted messages
5.2 Storage (Zero-Knowledge)
- Files encrypted client-side before upload
- Storage limits: Free (5GB), Pro (100GB), Team (500GB)
- We cannot access or scan your files
5.3 Email
- Custom domain email (Pro/Team plans)
- No tracking or ads in emails
- Standard email encryption (TLS/STARTTLS)
6. Pricing & Billing
6.1 Plans
- Free: $0/month, 5GB storage
- Pro: $9/month, 100GB storage
- Team: $29/month, 500GB storage
6.2 Payments
- Processed securely via Stripe
- Monthly billing (auto-renews unless canceled)
- Refunds within 30 days (prorated)
6.3 Cancellation
- Cancel anytime from your account settings
- Access continues until end of billing period
- Data retained for 30 days after cancellation
7. User Equity Program
Contributors earn platform equity based on:
- Code contributions (GitHub commits)
- Documentation improvements
- Bug reports and feature suggestions
- Community moderation

8. Intellectual Property
8.1 Your Content
- You retain all rights to your data
- We claim no ownership of your files or messages
- You grant us a license to store/transmit your data (to provide the service)

- Oursly.io code is open-source (Apache 2.0)
- Oursly™ trademark is owned by [YOUR COMPANY NAME - TBD]
9. DMCA & Copyright
We comply with the Digital Millennium Copyright Act (DMCA).

- We'll investigate and remove infringing content
- Repeat infringers will be banned

10. Termination
10.1 By You
Cancel anytime from account settings. Data deleted after 30 days.
10.2 By Us
We may suspend/terminate your account if you:
- Violate these Terms
- Abuse the service (spam, illegal content)
- Fail to pay (Pro/Team plans)
You'll receive 7 days notice (unless immediate termination required by law).
11. Disclaimers
SERVICE PROVIDED "AS IS"
Oursly.io is provided without warranties of any kind. We do not guarantee:
- 100% uptime (target: 99.9% SLA for Pro/Team)
- Error-free operation
- Data recovery if you lose your encryption keys
12. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability is limited to the amount you paid in the last 12 months
- We are not liable for indirect damages (lost profits, data loss, etc.)
- You are responsible for backing up critical data
13. Indemnification
You agree to indemnify Oursly.io from claims arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
14. Dispute Resolution
14.1 Governing Law

14.2 Arbitration
Disputes will be resolved via binding arbitration (except small claims court).
14.3 Class Action Waiver
